v-koba terms of service Version 1.0 1. Agreement These terms form a binding agreement between you and v-koba ("the platform", "we", "us") for your use of the v-koba group management service. By creating an account, signing in or using the service, you confirm that you have read, understood and accepted these terms and the privacy policy. If you do not accept them, do not use the service. Your VICOBA or SACCO group ("the group") also has its own constitution, rules and terms. Those group rules govern your membership of the group; these terms govern your use of the platform. 2. Who we are The platform is operated by v-koba. Your group is the owner of the membership, savings, loan and meeting records kept in the platform. We provide the software and infrastructure that stores and processes those records on the group's instructions. 3. Eligibility and accounts - You must be at least 18 years old and a member, officer or authorised representative of the group to use the service. - You must give accurate, current information and keep it up to date, including your name and phone number. - One account per person. Do not share your password, one-time codes or session with anyone. - Accounts created by a Chairman, Secretary or platform administrator stay subject to that officer's approval where the group requires it. - You are responsible for activity carried out through your account. Tell your group's committee immediately if you believe your account is compromised. 4. Your responsibilities - Review your passbook, statements, loan balances, fines and meeting attendance regularly and report errors to your committee promptly. - Make contributions and repayments as required by the group's rules. The platform records what is entered; it does not collect or hold money for the group. - Only enter records, approvals or verifications that you are authorised to make, and only when they are true. - Keep any downloaded statements, exports or receipts secure. 5. Group records and money The platform is a record-keeping tool. It is not a bank, SACCO, VICOBA, mobile-money provider or financial adviser, and it does not hold, insure or guarantee member funds. Balances shown depend on the entries made by authorised group officers and on records provided by the group. Any dispute about contributions, shares, loans, fines, dividends or group property is between you and your group, and is resolved under the group's constitution. 6. Acceptable use You must not: - use the service for fraud, money laundering, terrorism financing or any unlawful purpose; - impersonate another person or create accounts for people who have not consented; - attempt to access another group's records, another member's account or any data you are not authorised to see; - probe, scan, overload, disrupt or bypass the security or availability of the service; - scrape, copy or resell the service or other members' data; - upload malicious code, unlawful content or content that infringes another person's rights. We may suspend or restrict access to protect members, the group or the platform. 7. Personal data We process personal data as described in the privacy policy, which forms part of these terms. Your group is the controller of membership and financial records; the platform processes them on the group's instructions and is the controller of platform accounts, security logs and billing records. You may exercise your data-protection rights through the data request process available from your group's portal. 8. Availability and changes to the service We work to keep the service available, but it is provided on an "as available" basis. Maintenance, upgrades, connectivity, power and third-party providers may interrupt it. We may add, change or remove features, and we may change how records are displayed, provided the group's data is not lost. 9. Intellectual property The platform, its software, design and documentation belong to us or our licensors. Your group's records belong to the group. You may use the service only as allowed by these terms. 10. Suspension and termination We may suspend or terminate your access if you breach these terms, if your group asks us to, if your membership ends, or if the law requires it. On termination, your group keeps its records as required by law, and the privacy policy explains retention. Financial records may not be deleted while the group is required to keep them. 11. Disclaimers and limitation of liability To the fullest extent permitted by law, the service is provided without warranties of any kind, and we are not liable for indirect or consequential loss, loss of profit, or loss caused by entries made by group officers, by your group's decisions, or by events outside our reasonable control. Nothing in these terms excludes liability that cannot be excluded under Tanzanian law. 12. Governing law and disputes These terms are governed by the laws of Tanzania. Before starting formal proceedings, raise the issue with your group's committee and, if it concerns the platform, contact us so we can try to resolve it. Courts and other authorities of Tanzania have jurisdiction. 13. Changes to these terms We may update these terms. The version and effective date are shown at the top of this page. If a change is material, we will ask you to accept the new version the next time you sign in. Continuing to use the service after a version takes effect means you accept it. 14.
